Plain English summary
Use ScanMyArt to preserve your family's memories. Don't misuse it. Your content belongs to you. We keep the service running. If something goes wrong, our liability is limited. Questions? Email us.
1. Acceptance of terms
By downloading the ScanMyArt app or using the scanmyart.com website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.
2. Who can use ScanMyArt
You must be at least 18 years old to create a ScanMyArt account. By creating an account, you confirm that:
- You are 18 years of age or older
- You are the parent or legal guardian of any children whose artwork and voice recordings you add to the app
- You have the right to share any content you upload (artwork photos, recordings)
- You will use the service only for personal, family, non-commercial purposes
3. Your account
You are responsible for maintaining the security of your account credentials. Do not share your password. Notify us immediately at hello@scanmyart.com if you suspect unauthorized access.
We reserve the right to terminate accounts that violate these terms, at our discretion.
4. Your content
You own your content. The artwork photos, voice recordings, video stories, and transcripts you create in ScanMyArt belong to you and your family. We do not claim ownership of any content you upload.
By using ScanMyArt, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not use your content for any other purpose, including advertising or AI training.
You are responsible for ensuring that any content you upload does not infringe on the rights of others. Do not upload content you do not have the right to share.
5. Subscriptions and billing
ScanMyArt offers a free tier and a paid Pro subscription. Subscription billing is handled through Apple's App Store via in-app purchase. All subscription billing, refunds, and cancellations are governed by Apple's terms and policies.
- Free tier: up to 2 children, 30 uploads per child
- Pro: unlimited children and uploads, grandparent sharing, memory books
- Subscriptions auto-renew unless cancelled before the renewal date
- To cancel, use the standard iOS subscription management in Settings
6. Physical product purchases
Physical products (memory books, canvas prints, mugs, postcards, etc.) are purchased via Stripe and fulfilled by third-party print partners (Peecho, Printful). These are one-time purchases — not subscriptions.
All sales of physical products are final. Refunds are handled on a case-by-case basis for defective or damaged items. Contact us at hello@scanmyart.com within 14 days of delivery for any issues.
Shipping addresses for physical orders are collected by our payment and fulfillment partners. We do not store your shipping address in our database.
7. Teacher affiliate program
Teachers who participate in the ScanMyArt affiliate program do so as individuals, not as representatives of their school or school district. By signing up as a teacher affiliate, you:
- Agree to review your school district's policies regarding outside commercial affiliations
- Confirm that you are participating in your personal capacity
- Understand that ScanMyArt is not affiliated with or endorsed by your school or district
Commission payments are subject to a minimum balance of $25. We reserve the right to modify commission rates with 30 days notice.
8. Grandparent sharing
When you share a link to artwork, anyone with that link can view the artwork, play the voice story, and leave reactions. You are responsible for sharing links only with trusted people. Share links for individual artwork expire after 30 days. Family gallery links are permanent unless you reset them. You can revoke access at any time by resetting your gallery link in the app.
9. Prohibited uses
You may not use ScanMyArt to:
- Upload content that is illegal, harmful, abusive, or violates any third party's rights
- Attempt to access another user's account or data
- Reverse engineer, scrape, or copy any part of the app or service
- Use the service for commercial purposes without our written consent
- Upload content that is not related to children's artwork or family memories
10. Service availability
We aim to keep ScanMyArt available 24/7, but we do not guarantee uninterrupted service. We may perform maintenance, release updates, or experience outages. We are not liable for any loss caused by service interruptions beyond our reasonable control.
11. Limitation of liability
ScanMyArt is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for:
- Loss of data, including artwork photos or voice recordings, due to technical failures
- Indirect, incidental, or consequential damages of any kind
- Losses exceeding the amount you paid to ScanMyArt in the past 12 months
We strongly recommend keeping your own backup copies of irreplaceable photos and recordings.
12. Data backup recommendation
While we take data security seriously, ScanMyArt is not a backup service. For artwork and voice recordings that are irreplaceable, we recommend maintaining your own copies locally or in a separate cloud service. We will implement data export features to make this easy.
13. Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of San Diego County, California.
14. Changes to these terms
We may update these terms as the service evolves. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of ScanMyArt after changes constitutes acceptance of the updated terms.
